If buyers continue to browse and use this website they are agreeing to comply with and be bound by the following terms and conditions of use, which together with the privacy policy govern Commercial Kitchens Online's relationship with buyers in relation to this website. Product Descriptions

Description and details of equipment are provided by the relevant manufacturers.

All descriptive matter shown including product photo's, product description and specification, promotional text and technical drawings are provided to give an approximate indication as to the suitability of the product for the buyers intended use. If the product is not suitable for use from an operational perspective, the seller can not be held responsible and will offer no refund or return unless the equipment is unused with original packaging and accessories. (subject to an administration/re-stocking charge)

Payment & Prices

All prices on this website are shown excluding and including VAT at the current rate of 17.5% and are correct at time of print.

Seller and buyer agree that until full payment has been made for equipment and delivery the equipment remains the property of the seller.

The Commercial Kitchens Online web site allows buyers to purchase equipment directly over the internet. We use Protx online merchants to process our debit and credit card payments.

Protx security policy:

Security

As a Payment Service Provider, thousands of businesses outsource their transaction security to us. It is our top priority to ensure that transaction data is kept secure at all times.

Transaction security

All transaction information passed between merchant sites and the Protx VSP Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from Protx are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing you pass to the Protx servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

Encryption and Data Storage

Once on our systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign's Global Root certificate, making them all but impossible to extract. The data we hold is extremely secure and we are regularly audited by the banks and banking authorities to ensure it remains so.

Links to banks

Protx has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.

Employee access

No individuals within Protx are able to decrypt transaction information or cardholder data. Our systems only allow access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure even form our own employees because our systems never display the full card numbers, even on administration screens.

Cancellation

No cancellation, suspension or variation of this contract requested by the buyer shall be valid unless agreed with the seller in writing and such agreement will only be given, subject to adequate compensation or expenses incurred in connection with the contract and for the loss of profit.
In addition to the above compensation, the seller may impose a cancellation, restocking and administrative charge at its discretion.

Delivery

Free standard delivery (determined by supplier) applies to orders over £200.00 plus VAT to one UK mainland address. UK mainland excludes Northern Ireland, Isle of Man, Isle of Wight, Scottish Highlands, Islands and some areas of Scottish mainland. Orders to the value of £200 plus VAT will be subject to a delivery charge which will be detailed at time of order.

All orders under a value of £200 excluding VAT will be subject to a delivery charge of £14.90 + VAT.

Delivery of goods ordered will take place at the buyer premises which should be the address provided at the point of sale

Dates of delivery are considered as approximate

Every effort will be made to ensure that all items shown on our site will be available for delivery within 1 week from order. We can offer no guarantee of availability on products shown on our site. Goods are normally dispatched within 48 hours. If we are unable to carry out your order within 7 days, we will contact you by either by e-mail or telephone with an estimated dispatch date and offer you the option of canceling the order or selecting other goods.

Buyers will become the owner of the goods when they have been delivered and signed for. Once goods have been delivered they will be held at buyers risk and the seller will not be liable for their loss or destruction.

You have the right to refuse delivery of a damaged item. We ask that you please inform us immediately by calling 01384275759 so we can inform the relevant party and authorise removal from site.

A signature is required upon delivery for all goods delivered by the seller or its direct supplier.

Couriers will make delivery to the door (or site) only. They will not in any case, deliver items further than the entry door to the premises. Under no circumstances will delivery drivers be responsible for unpacking & positioning the equipment.

We ask that buyers ensure they have necessary personnel at time of delivery to position the equipment.

Goods must be examined upon delivery for all obvious signs of damage and a record of this should be added to the driver's paperwork so we ask that you add the words ‘un-checked package' adjacent to your signature or electronic pad. If for any reason this is not possible, we ask that the customer informs the seller within 24 hours of delivery receipt should there be any damage or missing items to your order.

Buyers must make sure they are aware of all dimensions of the equipment ordered to ensure it will fit in the desired location.

Items will be delivered to the delivery address specified at time of order but may not necessarily be signed for by the named contact.

All products are subject to availability

Unless otherwise stated, installation of equipment is the buyers responsibility.

It is a requirement that any gas appliance purchased from the buyer is installed by a Corgi registered gas engineer as required by law. A certificate from the engineer should be made available.

It is a requirement that any electrical appliance purchased are installed by a qualified engineer. A certificate from the engineer should be made available to the buyer.

Where a gas equipment is purchased, it is the buyers responsibility to ensure they have suitable extraction systems in place that meets the current regulations.

Failed Delivery

The seller reserves the right to charge for all failed deliveries. Costs the seller has incurred as a result of failed delivery will be passed onto the buyer.

In the case of a failed delivery goods will be returned to our warehouse or our direct supplier.

Any delay in delivery will not entitle the Buyer to cancel the order.

Returns

Return policy applies to all goods in an unused condition. All packaging and associated literature should be present.

Under the Distance Selling Regulations 2000 (DSR2000) the buyer has the right to return goods at their own cost within 7 working days starting from the date they signed for the goods. Any order that is placed with the seller may be cancelled only with the sellers written consent. If the cancellation is made after equipment is dispatched the buyer will be liable to pay for all associated costs. Items my not be returned without prior warning. An order number should be obtained from the seller prior to returning the goods.

Any special order / custom made equipment may not be returned unless it is found to be damaged and or faulty. The return of goods is entirely at our discression.

Warranty

Equipment warranty details vary by manufacturer. Details of warranty type and duration can be found in the product info on our website.

To validate the guarantee, buyers must fill out and register their product with the equipment manufacturer.

Manufacturers warranty will become invalid should the product failure be caused by overloading, abuse, misuse, tampering, neglect or accident or putting to use other than normally recommended by the Company.

Some manufacturers operate a ‘Back to base' warranty where the piece of equipment must be returned to base for repair. Should this be the case, we do not provide loan equipment until the repaired item is returned.

The seller attempts to deal with all warranty issues as quickly as possible. We are however bound by the terms and conditions of the equipment manufacturer. Warranty call outs may not be available at a time to suit the buyer.

To ensure your equipment is covered by the manufacturer warranty it is essential that Installation and commissioning (excluding 13amp plug only equipment) should be carried out to the manufacturers specification by a qualified engineer. If this is not the case, the warranty will become void and the buyer will be charged at the manufacturer discretion.

Force Majeure

The seller shall be entitled to cancel or rescind any contract without liability for any loss or damage resulting there from if the performance of our obligations under the contract is affected in any way by war, riot, Act of Government, strike, lock-out, dispute with workpeople, shortened hours of labour, fire, accident, non-availability of materials, stoppage or interference with transport, compliance with Government requirements, or any cause which we had no power to avert.
